$2.5M Jujyfruit Packaging Settlement Challenged

A $2.5 million nationwide class settlement resolving allegations that Jujyfruits, Red Hots, and Atomic Fireballs are deceptively packaged has been challenged.

A Wisconsin man who objected to the attorneys’ fee part of deal has appealed its approval to the U.S. Court of Appeals for the Ninth Circuit.

Thomas Iglesias alleged Ferrara Candy Co. sells candy in oversized boxes that consumers can’t see through, making them think they are getting more.

Suits over “slack-fill” are on the increase, but several recent cases have been dismissed.
