TTAB Denies Request to Apply EU Privacy Law to Trademark Dispute

The Trademark Trial and Appeal Board declined motions regarding the protection of and access to confidential information during the board’s proceedings between Intercontinental Exchange Holdings Inc. and Chicago Mercantile Exchange Inc. in a precedential order.

The board rejected ICE’s motion to apply a European privacy regulation to TTAB proceedings. The board’s standard protective order is sufficient to protect ICE’s confidential information, the TTAB said, denying ICE’s motion to apply the E.U.'s General Data Protection Regulation and ordering ICE to disclose the names and documents CME requested.
