T-Mobile User Says Data Breach Class Action Suit Should Proceed

A proposed data breach class action against T-Mobile US Inc. pending in California federal court should proceed because the telecom company failed to demonstrate “good cause,” the plaintiff argues.

T-Mobile’s own contractual provision mandates litigation in the place where each injured party resides, and the company doesn’t show an “urgent need” to pause the lawsuit, plaintiff Henry Thang argued in a memorandum filed Tuesday in the U.S. District Court for the Northern District of California.

Attorneys representing T-Mobile declined to comment.
