Suit Over Erroneous Criminal Histories on Consumer Reports Nixed

Allegations that an online consumer report compiler violated a federal consumer law by disseminating reports with inaccurate criminal histories was dismissed by a federal court in Virginia.

The issue whether Publicdata.com was protected from liability under the Fair Credit Reporting Act by the Communications Decency Act was novel, the opinion by Judge Henry E. Hudson of the U.S. District Court for the Eastern District of Virginia said.

The CDA says that no provider of “an interactive computer service shall be treated as a publisher or speaker of any information provided by another information content provider,” the court said.
