A proposed data breach class action against two radiology companies pending in New York federal court should be tossed because the plaintiffs didn’t allege cognizable injury, the companies argued.
Plaintiffs Jose Aponte II and Lisa Rosenberg lack standing under Article III, and potential exposure of their information doesn’t establish injury, Northeast Radiology P.C. and Alliance Healthcare Services Inc. argued in a motion to dismiss filed Thursday in the U.S. District Court for the Southern District of New York.
Attorneys representing Aponte and Rosenberg didn’t immediately respond to a request for comment.
