Michigan Insurer Must Face Class Claims Over Prerecorded Calls

National Health Plans & Benefits Agency LLC must face allegations that it spammed phone numbers that were registered on the National Do Not Call list with unsolicited calls, after a federal judge in Michigan refused to dismiss the suit.

Crystal Chapman filed a proposed class action against the insurance agency, alleging that it violated the Telephone Consumer Protection Act when it repeatedly called her using prerecorded messages.

NHP claimed that Chapman didn’t suffer any concrete injury from the calls, because her harm wasn’t particularized or concrete.
