Medical Hack Victims Claim Greenlighted by Georgia High Court

Patients who feared having their identities stolen after a hack of a medical clinic’s databases in 2016 alleged enough harm to allow a negligence claim, the Georgia Supreme Court ruled.

A state appeals court was wrong to dismiss the claim, because the patients’ allegations “raise more than a mere specter of harm,” Justice Nels Peterson wrote. A lower state court had ruled that the patients hadn’t shown enough harm for their negligence claim to move forward.

The decision shows how courts disagree with one another on whether plaintiffs suffer injury as a result of a data breach.
