Insurer of McDonald’s Operator Off Hook for Privacy Litigation

The operator of several McDonald’s restaurants lost its bid to get insurance coverage for a proposed biometric privacy class action it’s facing after an Illinois federal judge found the policy contained employment exclusions.

The American Family Mutual Insurance Company S.I. policy excludes coverage for employer-related alleged Biometric Information Privacy Act violations, Judge Harry D. Leinenweber wrote in an opinion filed Jan. 7 in the U.S. District Court for the Northern District of Illinois.
