Health Biometric Privacy Suit Sent Back to Illinois State Court

Automated Health Systems Inc. must face a former worker’s privacy-violation claims in state court after the Northern District of Illinois ruled he didn’t have standing.

Plaintiff Evelyn Hunter sued Automated in March 2019 for allegedly collecting fingerprint data for timekeeping without permission in violation of the Illinois Biometric Information Privacy Act, according to her complaint filed in Illinois state court.

Automated removed the case to the Northern District of Illinois in April, seeking to get the claims tossed because they were barred by the statute of limitations or preempted by the Illinois Workers Compensation Act, according to the opinion.
