Google Argues Children’s Privacy Law Preempts Biometric Claim

A proposed class action against Google LLC should be tossed out because the plaintiff’s biometric privacy claim is preempted by the Children’s Online Privacy Protection Act, the social media giant argued in Illinois federal court.

The complaint should also be dismissed because plaintiff Clinton Farwell fails to allege sufficient facts that would render his allegations plausible, Google argued in its motion to dismiss filed Thursday in the U.S. District Court for the Central District of Illinois.

Attorneys representing Farwell didn’t immediately respond to a request for comment.
