Background Check Company Sidestepping Credit Law, FTC, CFPB Say

The U.S. Court of Appeals for the Fourth Circuit should reject a background check company’s bid to “sidestep” federal law for credit reports, according to a statement from consumer protection agencies supporting a legal brief.

Heads of the Federal Trade Commission and the Consumer Financial Protection Bureau backed a brief Thursday submitted by their agencies’ lawyers in the case against Public Data, which provides online access to public records. The company is accused in a lawsuit from consumers of violating the Fair Credit Reporting Act by disseminating reports with inaccurate criminal histories.
