Debt Collector Escapes Suit Over Use of Third-Party Vendors

A Florida-based debt collector is off the hook for claims that it unlawfully used a third-party vendor to send letters to debtors because the plaintiff couldn’t allege that she actually suffered an injury from the practice.

Patricia Madlinger claimed that Enhanced Recovery Co. violated the Fair Debt Collection Practices Act when it used a third-party vendor to prepare and mail a debt collection letter regarding her Capital One credit card debt. Enhanced Recovery unlawfully disclosed her status as a debtor and the amount of debt she owed to Capital One to the third party, Madlinger alleged.
