Computer Fraud Claims Dismissed in Feud Between Golf E-Retailers

An online golf store had a Computer Fraud and Abuse Act claim against it dismissed after a Nevada federal judge found the website in question was public and not accessed “without authorization.”

The Nevada Computer Crimes Law claim against Top Shelf Golf LLC is dismissed for the same reason, Judge Andrew P. Gordon wrote in an order filed Thursday in the U.S. District Court for the District of Nevada.

Rival e-retailer Motogolf.com LLC sued Top Shelf in April, accusing the company of using software to click on Motogolf’s online advertisements so that its future ad costs would increase.
