California State Bar Seeks Data Breach Class Action’s Dismissal

The State Bar of California argues that a proposed data breach class action it faces over records scraping should be dismissed because the plaintiffs failed to properly state an invasion of privacy claim under the state’s constitution and other claims are not applicable.

The State Bar between October 2021 and February 2022 left docket data for attorney disciplinary records open to scraping, and the information was posted on the third-party site JudyRecords.com. Several of the 320,000 records contained a case type signaling mental illness or substance abuse issues.
