Banana Republic Lawsuit Over Secret Bathroom Recordings Revived

A lawsuit against Banana Republic over an employee’s video recordings of his co-workers using the bathroom was revived, with an Oregon appeals court ruling that employees have a legally protected interest in being free from the emotional trauma of being secretly recorded in a private restroom.

Banana Republic hired Johnny Tuck Chee Chan to work as a sales associate in May 2018, the court said, although the licensed pharmacist had been fired from a Kaiser Permanente pharmacy for secretly recording his co-workers in the store’s restroom in November 2017.
