American Eagle Wants Mall Workers’ BIPA Case in Federal Court

American Eagle Outfitters Inc. moved a proposed class action over its allegedly unlawful retention of employee fingerprints from state to federal court in Illinois, according to a recent filing.

The U.S. District Court for the Northern District of Illinois has jurisdiction over Maurice Stevens and Krystyna Hare’s lawsuit under the Class Action Fairness Act because their proposed class could comprise more than 100 current and former employees, the company said Wednesday in its notice of removal.
