Win for Sanofi in Suit Over Taxotere Breast Cancer Drug Appealed

A woman whose Taxotere lawsuit was dismissed as untimely has appealed a judgment for Sanofi U.S. Services Inc., maker of the breast cancer drug, according to a filing docketed Friday in the U.S. Court of Appeals for the Fifth Circuit.

Cynthia Thibodeaux’s suit would have been the second test trial in federal multidistrict litigation involving Taxotere. She alleged Sanofi didn’t warn that the drug could cause permanent hair loss.

But her suit filed in 2016 needed to have been filed by January 2011, the U.S. District Court for the Eastern District of Louisiana said.
