State’s Removal of Planned Parenthood From Medicaid Voided

South Carolina’s decision to terminate Planned Parenthood from Medicaid is void because it violates the Medicaid Act’s free choice of provider section, a federal court in the state said.

Planned Parenthood South Atlantic won summary judgment and a permanent injunction blocking South Carolina Department of Health and Human Services director Joshua Baker from ending its status as a Medicaid provider, the U.S. District Court for the District of South Carolina ruled Thursday.

The court previously granted PPSAT a preliminary injunction, which was affirmed by the U.S. Court of Appeals for the Fourth Circuit in October 2019.
