Some States Support Return of ACA Birth Control Exemptions

A 13-state coalition wants a federal appeals court to reinstate rules that allow employers with religious or moral objections to opt out of Obamacare’s birth control coverage requirements.

The group, led by Texas Attorney General Ken Paxton (R), told the U.S. Court of Appeals for the Ninth Circuit March 4 that a federal trial court incorrectly blocked the rules from taking effect in 14 states. Their brief supporting the federal government’s position argued that the Religious Freedom Restoration Act requires agencies to take religious views into account when drafting rules of general applicability.
