Justices Urged to Strike Arkansas Pharmacy Benefit Regulation

A U.S. Supreme Court battle over an Arkansas law regulating pharmacy benefit managers heated up Wednesday, when the justices received a slew of briefs urging them to strike down the law as preempted by the federal Employee Retirement Income Security Act.

Groups calling for an end to the Arkansas law include the U.S. Chamber of Commerce, America’s Health Insurance Plans Inc., and the Society of Human Resource Management. They join the Pharmaceutical Care Management Association, a trade group representing the PBM industry, in asking the Supreme Court to hold that the Arkansas law can’t operate alongside ERISA.
