The EPA has released DuPont de Nemours Inc. from two agency orders that required the company to test two separate PFAS, an action that prompted a federal court to dismiss a lawsuit the chemical manufacturer filed.
The US Court of Appeals for the Third Circuit dismissed on Monday a lawsuit DuPont de Nemours filed in March challenging the Environmental Protection Agency’s January order requiring it and other companies to carry out toxicity and other tests to provide the agency information on hexafluoropropylene oxide (HFPO), a particular per- and polyfluoroalkyl substance (PFAS).
