NY High Court Tackles Judge Age Limits
New York’s highest court today will consider whether the state’s constitutional requirement that judges stop serving by age 76 is superseded by a 2024 anti-discrimination amendment, Beth Wang reports.
Three judges who’ve surpassed the mandatory retirement age argue it was effectively repealed by the state’s Equal Rights Amendment, which banned discrimination for many reasons, including age. New York’s constitution “cannot be read to command and forbid the same thing at once,” the judges wrote in a court filing.
