SEC’s Disgorgement Case Doesn’t Bar Surescripts Suit, FTC Says

A Supreme Court case testing the SEC’s power to recoup illegal profits shouldn’t have any bearing on the U.S. government’s antitrust suit against a health information company, the Federal Trade Commission said.

Liu v. SEC, which is set for oral arguments in March, should be viewed as a separate matter that doesn’t impede the FTC from seeking disgorgement from Surescripts LLC, the FTC told a district court Jan. 10.

Since April, the FTC has sought both a permanent injunction and monetary relief from Surescripts over claims that the health company illegally monopolized the market for electronic prescription routing and eligibility....
