Reno Recycling Monopoly Survives Antitrust Appeal to 9th Circuit

Reno, Nev., didn’t violate antitrust laws by granting a recycling pickup monopoly to Reno Disposal Co., and neither did the company, the Ninth Circuit ruled Monday, saying the move was permitted by “a clearly articulated and affirmatively expressed” state policy.

“The Nevada legislature plainly intended to displace competition with regulation when it authorized municipalities to ‘displace or limit competition,’” the three-judge panel wrote.

The unpublished opinion by the U.S. Court of Appeals for the Ninth Circuit affirmed dismissal of a legal challenge by a rival company, Green Solutions Recycling LLC.
