Eversource, Avangrid Beat Redo Bid in Pipeline Capacity Case

Eversource Energy and Avangrid Inc. don’t have to face a redo of consumer claims that they inflated New England natural gas prices by intentionally booking excess pipeline capacity, the First Circuit ruled.

The $3.6 billion antitrust lawsuit alleged that the capacity limitations caused the wholesale cost of gas to spike, resulting in overcharges to retail electricity customers in six states. A federal judge tossed the proposed class action last year, saying it was preempted by the filed rate doctrine, which prohibits most antitrust challenges to utility prices regulated by an energy agency.
