Subway failed to convince a Texas appeals court that an arbitrator judge’s social media posts are grounds to toss a $2.9 million award favoring a store manager who was murdered on the job.
The state Court of Appeals, Fourth District said Wednesday the posts don’t demonstrate partiality and are “wholly unrelated” to the case. The justices, in confirming the award, also found no evidence that the judge deleted some of the posts, as the restaurant chain alleged.
