States Challenge EPA’s Lead and Copper Rule in Federal Court (1)

A group of states is seeking a federal appeals court’s review of the EPA’s latest regulations for drinking water pipelines containing lead and copper.

The Environmental Protection Agency’s December rule reduced the percentage of a water system’s lead pipes that need to be replaced each year. Nine states and the District of Columbia asked the U.S. Court of Appeals for the District of Columbia Circuit to vacate certain aspects of the rule.

The petition didn’t indicate which parts of the rule the court should vacate.
