Disability Rights New Jersey can review the private social media posts of a former senior staff attorney in connection with her claim that she was fired because she has lupus and cancer.
The novel ruling Thursday by the New Jersey Appellate Division said Norma Davis should produce that information after redacting posts that don’t involve comments or images relating to her “emotions, celebrations, vacations, employment, and health.”
Her posts may be relevant to Davis’ claims under New Jersey’s Law Against Discrimination because she seeks damages for her severe emotional distress, the court said.
