Multiple Indiana Abortion Provisions Declared Unconstitutional

Indiana abortion providers partially won their suit to block various state provisions regulating the procedure, as a federal trial court permanently enjoined laws banning telemedicine abortions and requiring hospitalization.

Six of the challenged provisions—including in-person examination requirements for medication abortions and preabortion counseling services—violate the 14th Amendment’s substantive due process and equal protection clauses, the U.S. District Court for the Southern District of Indiana said.
