Madoff Trustee’s Clawback Effort Against Swiss Bank to Proceed

Banque Lombard Odier & Cie SA can’t get an immediate appeal of a bankruptcy court’s ruling that it’s subject to jurisdiction in New York in a case brought by the trustee liquidating Bernard Madoff’s brokerage firm to repay Ponzi scheme victims.

The jurisdiction decision didn’t present a pure question of law suitable for immediate review, Judge Lorna G. Schofield said Wednesday for the US District Court for the Southern District of New York, which would handle an appeal from that district’s bankruptcy court.
