Louisiana Health Suit Rules Apply to Care Provided During Covid

A Louisiana mother and son lost their suit over an urgent medical care facility’s allegedly intentional mistreatment of the child’s strep throat, which led to the amputation of both his legs.

Danielle Hebert sued American Legion Hospital to recover damages for herself and her son, but she didn’t present the case to a medical review panel first, as required by the Louisiana Medical Malpractice Act. The case, therefore, was premature, the Louisiana Court of Appeals, Third Circuit, said.
