A Kentucky quarry owner failed to give proper notice before suing a local utility over alleged Clean Water Act violations, the Sixth Circuit said Friday in a ruling affirming dismissal of the lawsuit.
South Side Quarry argued the Louisville & Jefferson County Metro Sewer District used a diversion channel that regularly floods and pollutes Vulcan Quarry. The water utility needed and failed to get a required pollution permit for the Vulcan Quarry detention basin, the quarry owner said.
