Justices Eye Circuit Split Over Claims for Distributed Benefits

The US Supreme Court expressed interest in hearing a case asking whether state law claims for distributed life insurance proceeds interfere with federal benefits law, asking the ex-wife of a deceased man to respond to a petition filed by his estate.

The petition asks the justices to resolve a circuit split over whether the Employee Retirement Income Security Act preempts state law claims that seek to recover benefit plan proceeds that have been fully distributed to a beneficiary.
