Hospital’s Refusal to Give Covid-19 Patient Ivermectin Upheld

A Delaware hospital has no clearly established duty to treat a gravely ill Covid-19 patient with ivermectin because the treatment’s efficacy is disputed and it isn’t part of the current standard of care, a state court said.

Health-care providers generally must exercise ordinary skill and care within professionally accepted standards, the Delaware Chancery Court said.

Under state law, they “may decline to comply with an individual instruction or health-care decision that requires medically ineffective treatment or health care contrary to generally accepted health-care standards applicable to the health-care provider or institution,” it said.
