Gold King Mine Cleanup Claims Falter Over Court’s Jurisdiction

The federal district court in New Mexico doesn’t have specific jurisdiction over Kinross Gold Corp., a judge decided in ongoing litigation between the company and the U.S. over the costs of cleanup from the 2015 Gold King Mine blowout.

Kinross argued that its subsidiary, Sunnyside Gold Corp., ended operations at the mine when it closed in 1991. Judge William P. Johnson agreed, saying the record didn’t show continued operations at the site.

The U.S. District Court for the District of New Mexico, in an April 29 order, granted Kinross summary judgment on the issue of specific personal jurisdiction.
