Fast-fashion retailer Fashion Nova Inc. must defend proposed class action claims under Massachusetts, Pennsylvania, and New Jersey consumer statutes that it suppressed lower-starred consumer reviews, a federal trial court ruled.
The named plaintiffs allege injury under Massachusetts law, and ascertainable loss under Pennsylvania and New Jersey law, sufficient to survive a motion to dismiss, Judge Indira Talwani of the US District Court for the District of Massachusetts said.
