Durham Bulls Baseball Club Beats Suit by Fan Struck by Ball

The Durham Bulls minor league baseball team shook off personal injury claims by a fan seated in an area with no netting who was hit in the face with a line drive, after the North Carolina Court of Appeals ruled that the club wasn’t obliged to provide protective screening for all seats.

The club is shielded from liability by the “baseball rule,” which bars spectators who know of the danger of being struck by a ball from pursuing claims against baseball field “operators” who offer a choice between screened and unscreened seats, the court said.
