A Transportation Department program intended to help certain minority- and women-owned businesses was restricted across additional states while a lawsuit challenging its constitutionality proceeds.
DOT is further enjoined from implementing its Disadvantaged Business Enterprise program in every state that the two plaintiff companies bid on contracts in, not just Kentucky and Indiana, according to a Thursday order. The US District Court for the Eastern District of Kentucky filed the order in response to Mid-America Milling Co.'s and Bagshaw Trucking Inc.'s motion for clarification of a September preliminary injunction.
