Consumers’ claims that Thinx Inc. misrepresented that its underwear is safe and organic may continue, the Central District of California said Wednesday, finding they may be owed the amount they paid for the products.
Destini Kanan and Haley Burgess, who brought the class action complaint, said Thinx didn’t tell consumers that its absorbent underwear for women has per- and polyfluoroalkyl substances, a family of chemicals increasingly regulated at the state level. The U.S. District Court for the Central District of California denied the company’s motion to dismiss their breach of express warranty and equitable relief claims.
