The Census Bureau’s ability to compel responses to the American Community Survey withstood a constitutional challenge, after the Western District of Washington found the plaintiffs failed to show they are in danger of prosecution.
The proposed class action claims aren’t ripe for review because there is no evidence that the bureau threatened to prosecute either of the named plaintiffs, Maureen Murphy and John Huddleston, Judge David G. Estudillo said.
The plaintiffs’ generalized fear of prosecution isn’t enough to show they are subject to a genuine threat of imminent prosecution, Estudillo said.
