Brazilian Retail Chain Founder’s Estate Dispute Stays Out of US

A son of deceased Brazilian retail magnate Samuel Klein isn’t entitled to use the US courts to obtain bank records for an estate dispute with another member of the family, the Second Circuit ruled Thursday.

The documents would be in the possession of Saul Klein’s adversaries, including his brother Michael Klein, in the Brazilian litigation, the US Court of Appeals for the Second Circuit said in an unpublished opinion. “Courts within our Circuit have denied expansive requests similar to Saul’s,” the court said, affirming the lower court’s ruling. “We see no abuse of discretion.”
