The Energy Department is barred from imposing more stringent boiler efficiency standards without clear evidence that they’re feasible and will conserve energy, but the rule can stay in place pending further review, the D.C. Circuit said Tuesday.
The U.S. Court of Appeals for the District of Columbia Circuit’s decision in the consolidated cases came as a loss for industry groups that said they face significant disruption if the standards remain in effect.
