A Florida hospital defeated a fraud claim by a Black surgeon who alleged it took away his medical staff privileges in a sham peer review process meant to hide race and age discrimination, a federal trial court said.
Russell Brown didn’t allege fraud with enough specificity to allow the claim to proceed, the U.S. District Court for the Middle District of Florida said.
Brown, who died during the course of the proceedings, worked for BayCare Medical Group Inc. He was required to have privileges at Winter Haven Hospital Inc.
