Arizona lost its bid to enforce a law banning abortions based on a woman’s reason for wanting one, while the state appeals a decision blocking it.
The state defendants didn’t show they’ll be irreparably injured if they’re not allowed to require compliance with the provision, the U.S. District Court for the District of Arizona said.
The plaintiff abortion providers, on the other hand, would suffer substantial real-world harms if the law is enforced before its constitutionality is fully determined, the court said in Monday’s order by Judge Douglas L. Rayes, denying a stay pending appeal.
