Oil Field Camera Operators Get Overtime Win Upheld on Appeal

EVO Inc., which provides downhole video camera services to oil and gas companies, must pay more than $179,000 to a group of field engineers, after the Fifth Circuit ruled Tuesday they were misclassified as exempt from overtime.

The workers don’t qualify for the Fair Labor Standards Act’s exemption for administrative employees because they didn’t exercise any independent judgment in the course of their work or perform any duties directly related to EVO’s management or operations, the appeals court said.
