Victoria’s Secret Request to Review Showroom Patent Turned Down

Victoria’s Secret Stores LLC won’t get its chance to prove part of a virtual showroom patent is invalid, a Patent and Trademark Office tribunal said.

The agency’s Patent Trial and Appeal Board declined to reverse an earlier decision against instituting an inter partes review of claims in Andra Group LP’s 8,078,498 patent. Victoria’s Secret had asked the PTAB to reconsider its earlier decision, arguing the tribunal overlooked arguments and evidence proving patent claims invalid.

Andra Group—the parent company of online undergarment outfits HisRoom.com and HerRoom.com, according to its website—previously sued Victoria’s Secret for patent infringement with its own virtual showroom. ...
