A jury could find that a cartoon baby-face mask in Universal City Studios LLC‘s film “Happy Death Day” and its sequel “Happy Death Day 2U” infringes an artist’s copyright in his “King Cake Baby” design, a New Orleans federal court said.
The U.S. District Court for the Eastern District of Louisiana rejected Universal’s attempt to escape the case before trial on Wednesday, ruling that a reasonable person could find the designs are substantially similar.
