Trial Court to Weigh Lost Profits in Oil Exploration Patent Row (1)

A federal district court will determine whether a new trial is needed on lost profit damages in a patent infringement lawsuit by an oil and energy services company.

The U.S. Court of Appeals for the Federal Circuit Jan. 11 sent WesternGeco LLC’s lawsuit against ION Geophysical Corp. back to the U.S. District Court for the Southern District of Texas. The U.S. Supreme Court had sent the case back to the Federal Circuit after finding the appeals court improperly threw out a million-dollar award for lost profits to WesternGeco.
