Toro Co. saw an intellectual property win reversed when a federal appeals court said a Patent and Trademark Office tribunal erred in invalidating patent claims covering a lawnmower steering mechanism.
The Patent Trial and Appeal Board incorrectly concluded that the claims were obvious because they were based on old ideas, the U.S. Court of Appeals for the Federal Circuit said Aug 12. The court said the board’s decision was “predicated on its incorrect claim construction” of the term “mechanical control assembly.”
