Telegram Messenger Keeps Injunction Win in Crypto Trademark Case

Telegram Messenger Inc. properly received injunctive relief preventing Lantah LLC’s use of the GRAM trademark in the cryptocurrency industry, an appeals court affirmed in a nonprecedential decision.

A district court correctly found in August 2018 that Telegram first used the mark in commerce before Lantah filed its intent-to-use application, the U.S. Court of Appeals for the Ninth Circuit said.

The district court reasonably decided Telegram used the mark in commerce after assessing Telegram’s agreements to provide GRAMS to buyers worth $850 million, and publications reporting on Telegram’s efforts to offer the GRAM cryptocurrency, the court said.
